What is Title Insurance?
Title insurance helps protect against certain problems with the legal ownership of real estate that may already exist when you purchase the property but are not discovered until later.
Before closing, a title search examines the public records for matters that could affect ownership. But even a thorough title search cannot always reveal every problem. Title insurance provides an additional layer of protection if a covered title issue is discovered after closing.
Title problems can include:
- Unreleased mortgages or liens
- Errors in public records
- Missing or improper signatures on prior deeds
- Unknown heirs or probate issues
- Problems with deeds or legal descriptions
- Fraud, forgery, or unauthorized transfers

Owner’s Title Insurance vs. Lender’s Title Insurance
There are two primary types of title insurance involved in many Florida real estate transactions, and they protect different interests.

Owner’s Policy — Protects You
Helps protect your ownership interest and investment in the property, subject to the policy terms.
Lender’s Policy — Protects the Bank
Protects the mortgage lender’s interest. It does not provide the buyer with the same protection as an owner’s policy.
